Access to and use of the Blua Chemist Delivery Service is provided by Bupa Telehealth Pty Ltd (ABN 31 142 900 472) trading as Blua and its affiliates and related bodies corporate (“Blua”, “We”, “Us” and “Our”) on the following Terms. We reserve the right to change these Terms, the Website, and any content available on or accessible from this Website (“Content”) at any time by publishing these changes online. By continuing to use the Website or the Blua Chemist Delivery Service, you are taken to have accepted any changes to the Terms.

Blua collaborates with Chemist 2U Australia Pty Ltd (ACN 632 961 552) (“C2U”) to provide the Blua Chemist Delivery Platform (via the Website) and the Blua Chemist Delivery Services. To use the Blua Chemist Delivery Service services (referred to in the C2U Terms and Conditions as “C2U Services”), you will enter into an agreement directly between you and C2U.

As between you and C2U, the C2U Terms and Conditions will apply to your use of the Blua Chemist Delivery Platform and the Blua Chemist Delivery Services.

If you have a complaint or concern about the Blua Chemist Delivery Platform or the Blua Chemist Delivery Services, please contact C2U in the first instance on blua.support@chemist2u.com.au. If you have a complaint or concern about Blua or the Website or wish to discuss the Blua Chemist Delivery Platform or the Blua Chemist Delivery Services with Blua, please contact us on via support@blua.com.au.

To the extent permitted by law, Blua will not be liable (whether in contract, tort (including negligence) or otherwise) for any loss, damage or liability (whether direct, indirect, special or consequential) suffered by you in connection with your use of or access to the Blua Chemist Delivery Platform or the Blua Chemist Delivery Services or any failure to provide the Blua Chemist Delivery Platform or Blua Chemist Delivery Services including but not limited to:

1. any delay, incomplete, missing or erroneous orders in the Blua Chemist Delivery Services;
2. your reliance on the completeness, accuracy, suitability, security, currency or availability of the Blua Chemist Delivery Platform or the Blua Chemist Delivery Services; or
3. any misconduct of a deliverer engaged by C2U in connection with the Blua Chemist Delivery Services (“Deliverer”) or any failure by C2U to conduct background checks on a Deliverer.

3.1 Limitation of liability

To the extent permitted by law, Blua, its affiliates and related bodies corporate (as defined by the Corporations Act 2007 (Cth)), will not be liable (whether in contract, tort (including negligence) or otherwise) for any loss or damage (whether direct, indirect, special or consequential) suffered by you in connection with your use of or access to this Website and its Content, or any failure to provide this Website or particular Content.

To the extent permitted by law, Blua is not liable or responsible for:

1. failure to complete a booking on the Website;
2. your reliance on the completeness, accuracy, suitability, currency or availability of the Website, its Content or a specific health practitioner.
3. failure or delay of performance or in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third-party conduct, or theft, destruction, alteration or unauthorised access to records.
